1. Introduction

​

1.1 These Terms and Conditions govern the provision of services by Devon Locum Services Limited trading as Gentle Goodbye Vets ("we", "us", "our") to you, the client ("you", "your"). By booking and using our services, you agree to be bound by these Terms and Conditions.

2. Definitions

 

2.1 "Services" refers to the veterinary services provided by us, specifically home euthanasia for pets.

2.2 "Booking" refers to your request to receive Services from us.

 

3. Bookings and Acceptance

 

3.1 All Bookings made by you are subject to acceptance by us. We reserve the right to refuse any Booking for any reason.

3.2 Upon receiving your Booking, we will send you a confirmation. This confirmation does not constitute a contract for the provision of Services. A contract is only formed when we explicitly accept your Booking and agree on the date and time for the Services.

3.3 You are responsible for ensuring that the details of your Booking are accurate and that you provide us with complete information relevant to the Services.

 

4. Home Euthanasia Services

 

4.1 We perform home euthanasia for cats, dogs, and other small pets by appointment only, and only for pets that are already registered with a veterinary practice.

4.2 By booking an appointment with us, you confirm that your pet is under the care of your usual veterinary practice until the time of the appointment.

4.3 If, for any reason, the appointment does not go ahead, your pet will remain under the care of your normal veterinary practice.

4.4 We are recognized by the Royal College of Veterinary Surgeons as a limited service provider, offering only home euthanasia services. We are not able to provide any other veterinary services. For any other veterinary needs, you must seek the advice of your regular veterinary practice.

4.5 We do not provide an out-of-hours service for emergencies. In the case of an emergency, you are advised to contact your normal veterinary practice at which you and your pet are already registered or another emergency veterinary service provider.

4.6 We shall not assume responsibility for your pet’s veterinary care at any point prior to us attending your appointment. We shall attend your appointment only for the purpose of performing euthanasia. We shall not be obliged to offer any other veterinary advice before, during, or after your appointment.

4.7 We are not guaranteed to be contactable outside our normal working hours.

 

5. Fees and Payment

 

5.1 The fees for our Services will be as quoted at the time of your Booking or as agreed in writing.

5.2 All fees are in British Pounds Sterling (£) and include VAT at the applicable rate unless otherwise stated.

5.3 Payment must be made in full at the time the Services are provided unless otherwise agreed. We accept debit and non commercial credit cards (excluding American Express) and cash.

5.4 If you fail to make any payment by the due date, we reserve the right to charge interest on the overdue amount at a rate of 4% per annum above the Bank of England base rate.

 

6. Provision of Services

 

6.1 We will provide the Services with reasonable skill and care, as described at the time of your Booking.

6.2 While we strive to meet all agreed appointment times, there may be instances where delays occur due to circumstances beyond our control. In such cases, we will inform you as soon as possible and reschedule if necessary.

7. Cancellations, Rescheduling, and Refunds

 

7.1 You may cancel your appointment at any time up to your appointment. If you cancel, we will refund your payment, but we will charge a £20 fee to cover card processing fees.

7.2 You may reschedule your Booking by providing us with at least 24 hours notice.

7.3 We reserve the right to cancel or reschedule your Booking due to unforeseen circumstances. In such cases, we will notify you as soon as possible and offer an alternative appointment time.

 

8. Liability

 

8.1 We will not be liable for any loss or damage suffered by you as a result of any delay, cancellation, or failure to provide the Services due to circumstances beyond our control.

8.2 Our total liability for any loss or damage arising out of or in connection with the provision of Services shall be limited to the amount you have paid for the Services.

8.3 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

 

9. Client Responsibilities

 

9.1 You agree to provide us with accurate and complete information necessary for the provision of Services.

9.2 You are responsible for ensuring that any environment or conditions at the location where the Services are to be provided are safe for our staff.

9.3 You confirm that your pet is under the care of your usual veterinary practice until the time of the appointment with us, and that if the appointment does not go ahead, your pet will remain under the care of your normal veterinary practice.

9.4 In the event of an emergency, you understand and agree that we do not provide out-of-hours emergency services, and you should contact your regular veterinary practice or another emergency veterinary service provider.

9.5 You understand and agree that we do not take responsibility for your pet’s veterinary care before we arrive for your appointment. Our role is limited to performing euthanasia, and we are not required to provide any other veterinary advice before, during, or after the appointment.

10. Data Protection

​

10.1 We will use any personal information you provide to us in accordance with our Privacy Policy, which is available at [link to Privacy Policy].

10.2 By providing your personal information, you consent to us using it to provide the Services, process your payments, and for any other purposes set out in our Privacy Policy.

11. Force Majeure

​

11.1 We will not be liable for any failure to perform our obligations under these Terms and Conditions due to circumstances beyond our control, including but not limited to acts of God, war, civil unrest, or industrial action.

12. Governing Law and Jurisdiction

 

12.1 These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.

12.2 Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

 

13. Amendments

 

13.1 We reserve the right to amend these Terms and Conditions at any time. Any changes will be posted on our website and will apply to any Bookings made after the date of such changes.

 

14. Severability

 

14.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

 

15. Entire Agreement

 

15.1 These Terms and Conditions, together with your Booking, constitute the entire agreement between you and us relating to the provision of Services.
